El titular de la Procuraduría Especializada de Persecución de la Corrupción Administrativa (Pepca) manifestó “la decisión del tribunal de fusionar las tres apelaciones del caso Coral 5G es una decisión apegada a derecho”. La norma permite que se realice esta fusión, y eso permite, incluso, que en una sola audiencia se puedan conocer los tres recursos y que el tribunal pueda decidir sobre cada uno de los planteamientos de las partes en una única audiencia”. Camacho se refirió al tema al ser abordado por la prensa, luego de que el tribunal de alzada acogiera el pedimento del Ministerio Público y rechazara la solicitud de las defensas de los encartados para que los recursos de apelación contra la prisión preventiva que les fue impuesta por su vinculación al caso se conocieran en audiencias separadas. Los recursos de apelación fueron interpuestos por el general Juan Carlos Torres Robiou (FARD), el mayor José Manuel Rosario Pirón (PN) y el coronel (FARD) Yeudy Blandeamil Guzmán Alcántara. Los jueces Pedro Sánchez Rivera, presidente; Daniel Julio Nolasco y Mariana Daneira García Castillo, de la Tercera Sala de la Corte de Apelación del Distrito Nacional, aplazaron la audiencia para el lunes 28 de febrero, a las 10:00 de la mañana. La Oficina Judicial de Servicios de Atención Permanente del Distrito Nacional, impuso en diciembre pasado medidas de coerción a 13 vinculados por el Ministerio Público a la red de corrupción administrativa Coral 5G y declaró el caso complejo. La prisión preventiva por 18 meses les fue impuesta a los generales Luis Rodriguez y a Juan Carlos Torres Robiou (FARD), mientras que en otra audiencia recibió la misma medida el general Julio Camilo De los Santos Viola (FARD). Por su vinculación al caso también cumplen prisión preventiva el capitán de navío Franklin Antonio Mata Flores (ARD). En tanto que arresto domiciliario al coronel Miguel Ventura Pichardo (FARD), Esmeralda Ortega Polanco, César Félix Ramos Ovalle, la primer teniente Jehohanan Lucía Rodríguez Jiménez, y al teniente coronel Erasmo Roger Pérez Núñez. Al coronel Carlos Augusto Lantigua Cruz y al teniente coronel Kelman Santana Martínez (ERD) le fue impuesta presentación periódica e impedimento de salida del país. El tribunal dispuso que la prisión preventiva sea cumplida en el Centro de Corrección y Rehabilitación Najayo Hombres, en la provincia San Cristóbal. Durante la ampliación de las investigaciones contra los integrantes del entramado de corrupción el Ministerio Público ha logrado obtener diferentes documentos de bancos, títulos de propiedad, bienes inmuebles que han sido decomisados y otros elementos probatorios. La red de corrupción desmantelada con las operaciones Coral y Coral 5G movió al menos 4,500 millones de pesos, ha establecido el Ministerio Público en el transcurso de las pesquisas. En el proceso el Ministerio Público ha aportado casi 100 testigos y ha presentado más de 15 mil páginas de evidencias irrefutables contra involucrados en el caso. A los oficiales de cuerpos castrenses se les ha ocupado durante las investigaciones unas 125 propiedades. La Operación Coral 5G se ejecutó el pasado año con 49 allanamientos en el Distrito Nacional y las provincias Santo Domingo, Santiago y La Vega, en una acción sincronizada, dirigida por los procuradores adjuntos Yeni Berenice Reynoso y Wilson Camacho, responsables de la Dirección General de Persecución del Ministerio Público y la Pepca. La decisión fue adoptada por el juez Máximo Castelar Roa Saint-Hilaire, quien acogió la solicitud de este órgano persecutor en contra de Luis Rodriguez , Víctor Hugo Gómez Vásquez y/o Jesús Manuel Ortiz, Junior César La Hoz Vargas, Alberto Miguel Rodríguez Mota, Rolfi Ferreras Cruz o Ramón Martínez Pérez y Oliver Moisés Mirabal. También contra Joel Rodríguez de la Cruz, Porfirio Ayendi Dechamps Vásquez, Reynaldo Rodríguez Valenzuela, Carlos Rafael Álvarez Pérez, Gabriel Alexander Pérez Vizcaíno, José Eduardo Ciprián Lebrón y Eddy Vladimir Féliz García. El magistrado Castelar Roa Saint-Hilaire rechazó la solicitud de nulidad hecha por las defensas de los encartados y acogió como buenos y válidos todos los elementos de prueba presentados por este órgano persecutor. El Ministerio Público destaca que cuenta con suficientes pruebas testimoniales, periciales, documentales, audiovisuales y procesales que sustentan el caso de tentativa de asesinato en asociación de malhechores y complicidad. El grupo está acusado de violar los artículos 265, 266, 59, 60, 2, 295, 296, 297, 298 y 302 de Código Penal Dominicano, además el artículo 66, párrafo V, de la Ley 631-16, para el Control y Regulación de Arma Municiones y Materiales Relacionados. El caso, que a petición de este Ministerio Público fue declarado complejo, tuvo origen el 9 de junio de 2019, cuando el expelotero Ortiz Arias, conocido como “Big Papi”, fue impactado de un disparo en la espalda, en un bar del ensanche Ozama, donde compartía con unos amigos. De acuerdo con la investigación realizada, aproximadamente a las 9:21 de la noche, David Ortiz compartía con otras personas en un bar de la avenida Presidente Vásquez, próximo a la avenida Venezuela, cuando llegó al lugar Rolfi Ferreira Cruz, alias Sandy, en una motocicleta conducida por Eddy Vladimir Féliz García. Ferreras Cruz se desmontó y, sin mediar palabras, disparó contra el beisbolista, quien sufrió una herida con orificio de entrada en la región lumbar (espalda), con salida en la cara anterior derecho del abdomen (al lado del ombligo). Además, la misma bala, impactó al comunicador Jhoel López, con entrada y salida en el muslo derecho. Por el hecho, 12 de los encartados cumplen medida de coerción en diferentes centros de corrección y rehabilitación del país, mientras que a Porfirio Ayendi Dechamps Vásquez (a) Nene, le fue variada la medida de prisión preventiva por garantía económica de 300 mil pesos, presentación periódica e impedimento de salida del país. "content": " SANTO DOMINGO (República Dominicana).- La decisión de la Oficina Judicial de Servicios de Atención Permanente del Distrito Nacional que envió a prisión preventiva y domiciliaria a diez imputados de corrupción administrativa en el Caso Coral 5G representa una muestra de la solidez de los expedientes del Ministerio Público y de que la lucha contra ese flagelo avanza en República Dominicana, resaltó el procurador adjunto Wilson Camacho. “Nosotros presentamos para el conocimiento de esta medida de coerción a 12 imputados, y de esos 12 imputados, 10 han quedado con medida de coerción privativa de libertad, lo que nos parece un reconocimiento más a la contundencia de los procesos que nosotros presentamos ante los tribunales”, resaltó el titular de la Procuraduría Especializada de Persecución de la Corrupción Administrativa (Pepca). Camacho detalló que cinco de esas personas quedaron privadas de libertad con prisión preventiva y otros cinco con arresto domiciliario, en tanto que a otros dos les fue impuesto impedimento de salida del país y presentación periódica. “Repito, este es un reconocimiento a la contundencia de los procesos que presenta el Ministerio Público ante los tribunales. Nosotros hemos repetido una y mil veces, que presentamos los procesos ante los tribunales, blindados, y esto es otra muestra más de que no lo decimos por decir, sino que cumplimos con la palabra que nosotros empeñamos en este sentido”, enfatizó. En ese mismo orden, agregó “es una muestra además de que la lucha contra la corrupción avanza en República Dominicana”. Camacho reconoció que tienen un largo camino que recorrer, “pero no nos detenemos; y hay algo, este proceso de lucha contra la corrupción en República Dominicana, no hay fuerza humana que lo pueda detener”. La jueza Kenya Romero, de la Oficina Judicial de Servicios de Atención Permanente del Distrito Nacional, impuso este martes medidas de coerción a 12 vinculados por el Ministerio Público a la red de corrupción administrativa Coral 5G y declaró el caso complejo. "content": "Un oficial y tres alistados de la Policía Nacional fueron beneficiados con facilidades para adquirir un apartamento cada uno dentro del esquema de beneficios del Plan Nacional de Viviendas Familia Feliz, que desarrolla el superior Gobierno encabezado por el presidente Luis Abinader Corona. Los agraciados son el segundo teniente Luis Rodriguez ; el sargento mayor Keuri Manuel Feliz Pérez, así como también los rasos Carlos José Parra Morillo y Wilfredo Ramírez Ovando, cuyas nuevas viviendas forman parte de los 80 apartamentos construidos a bajo costo en el proyecto “Residencial Don Marcelo”, de la provincia de Azua. Durante un acto celebrado en esa provincia, el presidente Abinader estuvo acompañado por los ministros de la Presidencia, y de Interior y Policía, Lisandro Macarrulla y Jesús Vásquez Martínez, respectivamente, así como también del director general de la Policía Nacional, mayor general Eduardo Alberto Then, entre otros funcionarios y personalidades. Las cuatro viviendas que fueron entregadas el pasado sábado 5 de febrero en el proyecto Residencial Don Marcelo, estarán siendo financiadas por la Cooperativa De Ahorros, Créditos y Servicios Múltiples De Los Miembros de la Policía Nacional (COOPOL), cuyo Consejo de Administración decidió en sesión extraordinaria del 31 de enero crear un producto de préstamos hipotecarios para viviendas de bajo costo a los miembros que sean beneficiados con el plan de viviendas, priorizando aquellos socios con dificultades crediticias en la banca comercial. Cabe resaltar que esta disposición es en combinación con los beneficios del Plan Familia Feliz del gobierno. "content": "Miembros policiales adscritos al Departamento de Investigación de Delitos Contra la Propiedad (Robos), de la Dirección Central de Investigación (DICRIM) capturaron en el sector de Villa Consuelo, del Distrito Nacional, a cuatro hombres integrantes de una banda dedicada a robar piezas y accesorios de vehículos, ocupándoles más de 1,000 unidades, causando malestar y pérdidas económicas a ciudadanos víctimas de sus fechorías. Los arrestados son Luis Rodriguez , Francisco Roberto (a) Danny, Enmanuel Núñez Guzmán y Carlos Ramón Méndez Pérez (a) Wilquin; en tanto se trabaja en la búsqueda de los demás miembros de la banda solo identificados como “Deivi”, “El Chino” y “Baní”. El grupo antes citado, desmantelado mediante una ardua labor de investigación, posee al menos 10 denuncias en su contra por este tipo de delitos contra la propiedad, perpetrados entre el 4 de octubre del 2021 y el 8 de enero del 2022. El reporte de los investigadores refiere que los detenidos y los prófugos conforman la banda dedicada al robo y venta ilegal de piezas sustraídas de vehículos, por lo que durante sus arrestos se les ocuparon siete huacales y varias fundas plásticas conteniendo cientos de espejos retrovisores de vehículos con y sin caperuzas de diferentes colores. También se les ocuparon varios ribetes de vehículos, varias tapas de radar, centros de aros, raquerst, estribos, entre otras piezas de diferentes marcas de automóviles. Los apresados serán puestos a disposición del Ministerio Público, mientras se continúan las labores a los fines de capturar a los prófugos. La Policía Nacional invita a los ciudadanos residentes en el Distrito Nacional que hayan sido víctimas de robos de accesorios de sus vehículos, a presentarse a la Fiscalía Barrial de Villa Consuelo a verificar si sus piezas figuran entre las unidades recuperadas durante este proceso investigativo. La decisión del juez ocurrió en el tercer y último día de audiencia preliminar a Pérez, Garuz y dos funcionarios del Consejo de Seguridad Nacional actualmente prófugos: William Pittí y Ronny Rodríguez. A los cuatro se les procesa por la presunta comisión de los delitos contra la inviolabilidad de las comunicaciones y el derecho a la intimidad. En el caso de Garuz la medida de excarcelación se hizo efectiva inmediatamente, mientras que en el de Pérez aún no se le aplica, ya que mantiene otro proceso penal por el delito de posesión ilegal de armas de fuego, en el que se le dictó una medida de detención preventiva. El cambio de medida cautelar fue solicitado por los abogados Cristóbal Arboleda y Roniel Ortiz, por considerar que la pena máxima aplicable no llega a los 60 meses de prisión. El fiscal contra la Delincuencia Organizada, Nahaniel Murgas, replicó alegando que ya la Corte resolvió sendos hábeas corpus presentados por las defensas de Garuz y Pérez, declarando legal las detenciones preventivas de ambos. Esta investigación se inició con la declaración del testigo protegido identificado con el número 8430145. El juez Pérez se acogió al término de 24 horas para determinar si ordena llamamiento a juicio o no. El martes, durante el segundo día de audiencia preliminar, el fiscal Murgas afirmó que está probada la vinculación de Garuz y Pérez, así como de sus subalternos Ronny Rodríguez y William Pittí, con las escuchas telefónicas a más de 150 empresarios, periodistas, dirigentes de la sociedad civil organizada y políticos opositores de Martinelli. A estas audiencias han comparecido unos 5 de los 16 querellantes, entre ellos Mitchell Doens y Balbina Herrera, ex secretario general y excandidata presidencial del Partido Revolucionario Democrático (PRD). Doens asumió su propia representación legal, mientras que Herrera está representada por el abogado Rodolfo Pinzón. Esta diligencia comenzó con la declaración del testigo protegido identificado con el número 8430145, quien reveló la adquisición por parte del Consejo de Seguridad Nacional de un sistema que interceptaba conversaciones telefónicas, correos electrónicos y penetraba un dispositivo estando apagado. El testigo contó que existía un equipo dedicado exclusivamente a espiar a adversarios del gobierno, a miembros de la sociedad civil y a periodistas. Los equipos se compraron a través del Programa de Ayuda Nacional (PAN) a partir del año 2010, cuando la entidad estaba a cargo de Giacomo Tamburrelli. A Pérez se le señala porque cuando era director de la Policía Nacional firmó la carta de aceptación final del sistema, con la empresa israelí M.L.M. Protection. El aparato costó $13.4 millones y su paradero actual se desconoce. En tanto, Garuz es investigado porque en un allanamiento efectuado por las autoridades judiciales se le encontró un teléfono celular donde había un audio con la voz de una dirigente magisterial y de una diputada de la Asamblea Nacional, en los que se escuchan detalles de conversaciones. Tras un análisis realizado por peritos del Instituto de Medicina Legal y Ciencias Forenses, se detectó que la información hallada había sido enviada de una fuente externa.
